Terms of Service
The terms of your Deeplathe subscription.
Plain-English first, then the specifics. Read both.
Effective August 23, 2026· Deeplathe is a brand of Enliven Sports LLC (Wyoming, USA)
In plain English
- It's a subscription service, not a one-time build. We design, host, run and maintain your website and/or AI receptionist for a monthly (or annual) fee.
- Your money back for 30 days. Start from a working preview we build for you, or buy a plan outright — either way you are covered for 30 days; see the guarantee below.
- It auto-renews, and you can cancel anytime. No lock-in, no cancellation fee. Cancel from your portal or by email; service runs to the end of the period you've paid for.
- Your content, domain and data are yours. You can take them with you. Because we operate the service for you, the underlying source code stays ours.
- If payment fails, we don't just cut you off. There's a grace period, and if your AI receptionist is suspended, callers are routed to your own line — never dead air.
- We don't promise specific results. We describe what the service does; we can't and don't guarantee revenue, rankings or lead volumes.
1. Who you're contracting with
Deeplathe is a brand of Enliven Sports LLC, a limited liability company registered in the State of Wyoming, United States. "Deeplathe", "we", "us" and "our" mean Enliven Sports LLC. "You" means the business or person subscribing. These Terms, together with the the guarantee in our terms and Privacy policy, form the agreement between us. By subscribing you accept them.
2. What we provide
Depending on your plan, we provide one or more ongoing services: a hosted website; an AI receptionist (voice and/or chat) that answers, books and takes messages; a contacts/CRM view; and related hosting, maintenance, monitoring, updates and support. What your plan includes is described at checkout and in your portal. This is a service we operate for you, not a deliverable we hand over.
3. Subscription, billing & auto-renewal
Your subscription is billed monthly (or annually if you choose) in advance, plus any one-time setup fee shown at checkout. Payments are processed by Stripe; by subscribing you authorise us to charge your payment method on each renewal.
Your plan automatically renews for successive periods (each month, or each year on an annual plan) at the then-current price until you cancel. We email a receipt for each charge. We'll give you at least 14 days' notice by email before any increase to your recurring price; if you don't want the new price, you can cancel before it takes effect. Usage beyond what your plan includes (e.g. call minutes over your bundle) is billed as metered overage at the rates shown at checkout.
There is no setup fee. Every plan is one flat monthly (or annual) price with $0 setup — the build, your domain and your business email are included.
4. The 30-day money-back guarantee
There are two ways to start, and the same guarantee covers both. If we scope the work on a call, we build it and present the finished thing to you on a second call — deployed and working, not a mockup — and only once you confirm does any money change hands. If you buy a plan directly from the pricing page, the first payment is taken up front and we begin the build straight away. Either way, if within 30 days of going live you decide it isn't right for you, tell us and we'll refund everything you've paid. Email info@deeplathe.com; no hoops. Approved refunds are issued within 5 business days.
5. Refunds after the first 30 days
After the guarantee window, your subscription works like any monthly service:
- Monthly plans. Cancel anytime and you won't be billed again. Your service continues to the end of the month you have already paid for; we don't charge a partial month, and we don't pro-rate a refund for the current one.
- Annual plans (pay nine months, get twelve). If you cancel partway through a prepaid year, we refund the unused whole months remaining, at the annual rate you paid.
- Metered overage — call minutes used beyond your bundle, for example — is for service already delivered and is not refundable.
6. How refunds are paid
Approved refunds go back to your original payment method via Stripe, usually within 5–10 business days depending on your bank. If you paid in GBP or AUD you are refunded in the same currency you paid.
7. Cancellation
You can cancel at any time, with no cancellation fee and no lock-in. Cancel from the billing section of your portal (which opens the Stripe customer portal) or by emailing info@deeplathe.com. When you cancel, your subscription does not renew again; your service continues until the end of the period you've already paid for, then stops. You can export your content and data, and take your domain, on the way out. There is no cancellation fee and no phone-call-to-retain gauntlet — your plan simply stops renewing.
8. Late or failed payment & suspension
If a renewal payment fails, we don't cut you off immediately. The sequence is:
- Grace (days 0–7): service stays fully on; we email and text you to update your card.
- Restricted (days 7–14): service continues but new bookings/changes may pause; daily reminders.
- Suspended (day 14+): the service is paused. If you have an AI receptionist, incoming calls are routed to your own phone or voicemail — never dead air. Restore instantly by paying the outstanding amount.
- Terminated (day 45–60): the subscription is closed and any assigned phone number may be released. We retain your data for the period stated in the Privacy policy so you can still recover it.
9. Your content, domain & data — and what stays ours
Your business content, your domain and your customer data are yours. You can export your data and move your domain at any time; we don't hold them hostage. Because Deeplathe is an operated service (we host, run and maintain it), the underlying source code, templates, systems and any AI configuration remain our intellectual property and are not transferred to you. Standard domain registration is included while you're subscribed, subject to the cap shown at checkout.
10. Acceptable use
You agree not to use the service for anything unlawful, deceptive or abusive: no illegal content, no fraud, no infringing others' rights, no attempts to break, overload or reverse-engineer the service, and no using the AI receptionist to mislead your customers. You're responsible for the accuracy of the business information you give us (hours, prices, services) and for having the rights to any content you provide. We may suspend service for serious or repeated breaches.
11. Our commitments & what we don't promise
We'll provide the service with reasonable skill and care and aim for high availability, but we don't guarantee it will be uninterrupted or error-free. We do not promise specific business outcomes — revenue, lead volume, call numbers, or search-engine rankings. Where we mention what an alternative costs, those are illustrative comparisons, not promises about your results. AI systems can occasionally make mistakes; you're responsible for reviewing anything material (e.g. bookings) and we'll fix issues promptly when flagged.
12. Intellectual property & reviews
You grant us a limited licence to use your name, logo and content solely to provide the service (and, unless you opt out, to show your finished site as an example of our work). We may ask your customers for honest reviews after service; we never filter reviews by sentiment or gate them, consistent with applicable law.
13. Liability
To the extent permitted by law, our total liability to you for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim. We're not liable for indirect or consequential losses (e.g. lost profits or missed opportunities). Nothing in these Terms limits liability that can't be limited by law.
14. Changes to these terms
We may update these Terms. If a change materially affects you, we'll notify you by email before it takes effect; continuing to use the service after that means you accept the change. The effective date above shows the current version.
15. Governing law
These Terms are governed by the laws of the State of Wyoming, United States, and disputes are subject to the competent courts of that state, except where mandatory consumer or local law gives you other rights. This is a business-to-business service.
